Applying for review at the Administrative Review Tribunal

If your onshore visa application has been refused and cancelled, you have the option to request a review at the Administrative Review Tribunal. This includes a wide range of visa types, such as visitor, student, partner, family, business, skilled, and protection visas. It is essential to note that strict time limits apply to making an appeal and cannot be extended. These time limits vary depending on the type of decision and whether you are in immigration detention.

Appeal costs for review of general visa application decisions

There are fees associated with having a visa decision reviewed by the Tribunal. Typically, applicants are required to pay a fee of AUD$3,496 from 1 July 2024 when they apply. However, if paying the fee would result in severe financial hardship, the application fee can be reduced by 50%. If the review is decided in your favour, the ART will refund 50% of the fee you paid.

Appealing decisions of the Tribunal

In the event that you apply for a review of a decision at the Tribunal and lose the case, you may be able to appeal to the Federal Circuit Court.

Offshore Visa Refusal and Cancellation

In some cases, offshore visa refusal decisions may be reviewed by the Administrative Review Tribunal. This depends on the specific visa types and the applicants’ circumstances. If your visa has been cancelled while you are offshore, you may be eligible to apply for revocation of the visa cancellation directly with the Department of Home Affairs.
