Partner (Provisional) Subclass 309
Overview
This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia temporarily. Getting this visa is the first step towards a permanent Partner visa (subclass 100).
Basic Eligibility requirements
- You must have a sponsor and the sponsor must be your partner.
- You and your sponsor must be 18 years or older.
- You must be married or in a de facto relationship with an Australian Citizen, Australian Permanent Resident or Eligible New Zealand Citizen.
- If you are in a de facto relationship, you must prove that you are in the de facto relationship for at least 12 months immediately before you apply for this visa, unless exemptions apply.
- You and your partner’s relationship must be committed, genuine and continuing.
- You must prove that you and your partner meet the following four factors:
- Joint financial aspects of the relationship.
- Join nature of the household arrangement.
- The social aspects of the relationship.
- The nature of the couple’s commitment to one another.
- You must meet the health and character requirements.
- You must be outside Australia when you apply for the visa.
